A Regular Meeting of the Township Council of the Township of
Roxbury was held on September 13, 2005 at 1715 Route 46, Ledgewood, N.J. at
7:30 p.m.

Adequate
notice of this meeting of the Township Council of the Township of Roxbury was
given as required by the Open Public Meetings act as follows: Notice was faxed
to the Daily Record, the Newark Star Ledger and the Roxbury Register on January
5, 2005; notice was posted on the bulletin board in the main hallway of the
Municipal Building on January 5, 2005.

Ms.
Dellamonica stated that there is a severe problem with the speed of cars on Shippenport Road.
Ms. Dellamonica stated that she spoke with Chief Noll several times with no
resolve. She also stated that she had called people in the “traffic” department
and nothing transpired. Ms. Dellamonica stated that she was told she would get
a speed limit sign in front of her home 2 years ago and she still does not have
the sign. Ms. Dellamonica stated that she brought this to the attention of Mr.
Raths three weeks ago and he told her that it would be addressed and the sign
has yet to be put up. Ms. Dellamonica also stated that she called again last
week to inquire about the sign and was told that they were busy preparing for
Suckasunny Day, but that it would be installed after that. Ms. Dellamonica
stated that Suckasunny Day was held on Saturday, September 10, 2005 and that today is Tuesday, September 13, 2005 and
their still is no speed limit sign put up.
Ms.
Dellamonica also stated that she has spoken with Rick in Public Works regarding
striping and she was told that it was not feasible because it is such a small
portion, but if they happen to be doing a larger area and have some left over
they could then do it. Ms. Dellamonica also stated that she has been told as
well that Wellfleet well take care of it.
Ms.
Dellamonica also stated that the Township is neglecting weeding and trimming of
Township owned property near her home because it is considered “wetlands”.
Mr.
Raths stated he has asked the Chief to put up the speed limit sign and will
look into it and it should be done.
Mr. Rilee stated he was pushing for a light in that area
but the area is not qualified for one. Mayor Zoschak stated that with the new
development it may change the qualifications to get a traffic light in that
area.
Mr.
Raths also stated that he has asked Rick Blood of Public Works to put up
additional Children at Play signs and hidden driveway signs on Shippenport
Road.

Ms.
Bovasso stated that the speed limit on Dell Avenue, 30 m.p.h. is to high. Ms.
Bovasso stated that she called a Police Officer in June of 2005 to observe her
concerns about traffic and speed on her road and that he observed 16 trucks go
by within a 5 minute period. Ms. Bovasso also stated that people drive up to
40 m.p.h. on this road and that this has been going on for over 30 years. Ms.
Bovasso also stated that on August 23rd she sent an e-mail to Town
Hall and received no response.
Mayor Zoschak stated there was a study a few years ago
and that County Concrete, his fleet of trucks were doing the speed limits at
that time.
Mr. Raths read off some statistics to show that they have
been doing patrols in the area.
Ms.
Bovasso suggested we put up signage to prohibit compression brakes. Mr. Raths
stated that there is a legal question if this is even enforceable.
Mr.
Raths stated that 6 trucks were running from 3:30 a.m. to 3:45 a.m. and the
Police Department is investigating.
Mr.
Bucco stated that the Council recently rezoned that area and over the years the
types of land uses have changed dramatically.

Zoschak suggested that a 35 m.p.h. painted sign on the road could benefit and
it can be done immediately.

Mr.
Vanderbush stated that there is no need for compression brakes on Dell Avenue –
that this is a flat road. Mr. Vanderbush also stated that he is upset that
since the year 2001, tractor-trailers have been parked in residential areas.
Mr. Vanderbush also stated that since August 18, 2005 he has witnessed 6
tractor-trailers parked illegally at Franks Nursery and the Car Wash on
Railroad Avenue, and at other locations in Town. Mr. Raths stated he has
spoken to the Chief of Police to enforce our laws.
Mr.
Vanderbush also stated that we have no idea what are in these box trucks – they
could be toxic. Mr. Vanderbush also stated we have many unregistered vehicles
parked. Behind his house there has been an unregistered vehicle for over 2
years. Mr. Vanderbush mentioned the incident that happened in Camden earlier
this year with the 3 children found dead in the trunk.
Today Mr. Vanderbush stated there are 14 vehicles
displayed for sale from Kenvil Avenue to Hillside Avenue and wants to know why
this is allowed.
Ms.
DeCroce, Township Clerk stated that she issues the licenses and she was not
aware of these cars. If notification is given to the Zoning Officer or herself
they would take action.
Mr.
Bucco stated that jake brakes are not enforceable. Mr. Vanderbush stated if
you call it compression brakes you should be able to enforce it.

Ms. DeHaas thanked Mr. Raths for the sidewalks that are
about to be put on her road. She also stated that people are using her road as
a cut through to get to Route 46. Ms. DeHaas stated that she has called the
Police Department several times with no resolve.
Mr. Hall stated that we need to address this issue and
find out why phone calls are not getting returned to the Public. Mr. Rilee
stated that this is starting to become a pattern that phone calls are not being
returned and that has to change.

Ms. Korpos stated that Mine Hill is making an Ordinance
to enforce compression brakes in that Town and it will be enforceable. Ms.
Corpus also stated that she has addressed traffic on Railroad Avenue and has
crusaded on this issue and received no input back from the Roxbury Township.

Mr.
Reed thanked Mayor Zoschak for the Hercules Plaque and the late Mayor Thomas Vickery
for all their help in getting the Memorial set up at Horseshoe Lake. Mr. Reed
also thanked Mr. Raths and his Assistant and the Building Department, Police
Department, and the Newspapers for the articles they printed about the
explosion. Mr. Reed also stated that yesterday was the 65th
Anniversary of the blast at Hercules.

Ms. DeFillippo stated that Landing Road in Landing is a
bad intersection and an accident occurred there a few days ago by the traffic light.
Mayor Zoschak stated that the driver had a seizure.
Ms.
DeFillippo also complained about railroad ties lying behind the Mall and that
they need to be picked up.
Ms.
DeFillippo also questioned about the park in Berkshire Valley and why it is
being repaired in the winter and not now. Mr. Raths stated the Church
previously made repairs.
Ms.
DeFillippo also stated that the corner of Righter Road and Clearfield Road in
Succasunna needs a street sign. Ms. DeFillippo also stated that the Hillside
Avenue paving job is great.

Mr.
Alpaugh stated that the study for the Fire Annex is still open. Mayor Zoschak
stated that Mr. Raths is currently working on this. Mr. Raths stated that he
is looking at surrounding Communities and Duty Crews and a new method of
evaluating response times are being explored.
Mr.
Alpaugh stated that Mr. Wilson and Ms. Cole are both recovering from serious
health illnesses and that they are the only 2 full-time volunteer EMS workers.
Mr. Alpaugh also stated that “we need ACTION – no more TALKING!” Mr. Raths
stated that he has a report to go out in the Council’s package this week in
regards to the Fire Departments.
Councilman Rilee questioned Mr. Alpaugh on how he feels
about the hospital taking calls. Mr. Alpaugh stated that was not a long-term
solution.

Councilman
Rilee stated that the Open Space walking tours were very positive with the
County. Mr. Rilee stated he received his memo on fuel costs and wants to know
the impact this is having on the Town’s budget. Mr. Raths stated that Lisa
Palmieri is working on an analysis. Mayor Zoschak pointed out that Bergen
County buys fuel in bulk with other Counties. Mayor Zoschak recommended
looking into doing this with other Municipalities. Mr. Raths stated that we
currently have an arrangement with the Board of Education. Mayor Zoschak
stated that buying a greater amount of fuel and combining with other
Municipalities would be a smart savings.

Ciaramella stated that the Economic
Development Committee meeting is this
Thursday, September 15, 2005 at 7:00 a.m. – 9:00 a.m. at Town Hall. Mr.
Ciaramella questioned about the progress on the D.P.W. building. Mr. Raths
stated that the D.P.W. building will be on the next Agenda (September 27th)
and would be discussed at that time. Also to be discussed will be signs.
Councilman
Ciaramella asked for an update on the work in the Port Morris area on Main
Street. Mr. Raths stated they are done.
Councilman
Hall stated that the intersection of Hillside Avenue and Righter Road are being
worked on right now and stated that Mr. Rilee needs to be thanked for the
progress.
Mr.
Hall also thanked Mr. Raths and Lucinda Taterka, in the Managers Office, for
their work on the Hercules Memorial.
Councilman
Hall stated that he attended a Board Of Education meeting last week and a report
was presented indicating there were significant reductions in school violence
in Roxbury.
Mr.
Hall also stated that BettyLou DeCroce, Township Clerk and Rob Kuncken, I.T.
Director will be putting our Ordinances on-line within the next several weeks.
All of the Township Ordinances will be available on the Roxbury Township web
site. Ms. DeCroce stated this should be up and running by the end of December,
including the Land Use Ordinances.

Schmidt stated he has a speeding issue on Nyma Way and would like increased
enforcement in that area.
Mayor
Zoschak stated he was invited to the Senior meeting on Friday. Mayor Zoschak
also stated that Suckasunny Day, held on Saturday, September 10th was a great
success. Mayor Zoschak also informed Council that Mayor Hodsen of Hopatcong
had a stroke and he sends his sympathy to him & his family. Ms. DeCroce
stated that she sent a card to him from the Governing Body of Roxbury Township.

DeCroce, Township Clerk stated she spoke with Redmond Press yesterday in
regards to the Roxbury Image Newsletter and that they are able to print the
newsletter cheaper than the previous provider – Summit AdGroup. Ms. DeCroce
also stated that the newsletter will not be going out on this quarter because
we have to find another funding source. Ms. DeCroce stated that she needs a
Committee to work with her to raise the funds to supplement the sponsors she
already has. Ms. DeCroce questioned the Council Members on who would be
willing to help her and join this Committee. Mr. Raths, Township Manager;
Martin Schmidt, Council Member and Mayor Zoschak all agreed to help and be part
of the Committee.
Councilman
Hall questioned Ms. DeCroce if she needed any help with the format of the
newsletter. Ms. DeCroce stated that she does not because she is requesting the
template from the Summit AdGroup, which is the property of Roxbury Township.
Ms.
DeCroce stated that she and Councilman Schmidt went to a class today in
Freehold on Public Archives & Records. Ms. DeCroce stated that there
are many grants to choose from, but they are mostly going to the Cities and not
rural areas like Roxbury. Ms. DeCroce stated that they left the class before
it finished with great disappointment.
Councilman
Hall was disturbed by this because Roxbury will not receive funding. The
County previously received a grant and is in the process of implementing an
Archival System. They are placing all their paper documents into this system,
and this information well then be made available on-line to the public.
Councilman Hall stated that he believed that the Paris Grants were going
to be handed out to all the municipalities, not just the big cities.
Ms.
DeCroce stated that she spoke with some Legislators about these Grants and that
they are interested in who is and is not getting them. Mr. Hall suggested we
put a package together to send to the County and let them know how much in need
we are for this funding. Ms. DeCroce agreed and stated this is going to be a
large issue.
Ms.
DeCroce stated that she will be sending out a copy of the 2006 Calendar in this
week’s packages. Ms. DeCroce asked Council to decide on a date for the
Reorganization Meeting in January and Council agreed on the first Tuesday of
the month - January 3, 2006.
Ms.
DeCroce also noted that Redmond Press is the Agency that already prints our
Township Calendar and they are familiar with our mailing routes.

Councilman Hall questioned Mr. Raths about this meeting. Mr. Raths stated that
this meeting has been cancelled as of today. Mr. Raths stated he would try to
reschedule this meeting. Mr. Raths also stated that a letter went out in an
earlier Communication asking each department to make a list with any comments
or suggestions. Mr. Hall asked for a copy of our current Cable Contract. Mr.
Raths stated he would provide him with one.

of Roxbury Township dated August 26, 2005 Re: Planning Assistance Grants –
Council on Affordable Housing (COAH) Planning Grants for 3rd Round
Municipalities. Councilman Hall questioned Mr. Raths if we need to do anything
about this. Mr. Raths stated we are in the middle of our certification process
right now.

Michael A. Kobylarz, Township Engineer/Director of Public Works dated August
24, 2005 Re: Sanitary Sewer Extension to serve 6 Roxbury Township Homes on
Parker Road. Mr. Rilee questioned Mr. Raths if he is looking for guidance to
go forward on this project. Mr. Raths stated that Mr. Kobylarz is getting the
cost estimates and that they will be contacting residents shortly.

2005 Re: Information Update. Mayor Zoschak questioned Mr. Raths on what the
Township Ordinance has to say about hooking up to sewer lines. Mr. Raths
stated that everyone wants to hook up to the sewer line, put they don’t want to
pay. According to our Ordinance the residents have to pay stated Mr. Raths.

Compliance Enforcement, State of N.J.D.E.P. to Warren Potter of Roxbury Auto
Wreckers, Inc. dated January 27, 2005 Re: Administrative Consent Order &
Settlement Agreement for Roxbury Auto Wreckers, Inc. (RAW). Councilman Rilee
questioned why this is extended once again. Mr. Raths stated that they are not
allowed to bring in any new tires and that the D.E.P. is handling this.
Councilman Hall asked about Roxbury Auto Wreckers taking tires from residents
of the Township. Mr. Raths stated that they came in about 1 year ago and made
a presentation and they have not followed up on it.

Pertaining to Hurricane Katrina. Councilman Schmidt stated that the V.F.W.
along with others are collecting donations for the victims and that everyone
should support this cause.

Re: Request for Assistance on Release of Technical Documents Regarding Basis
for Wanaque Reservoir TMDL. Councilman Rilee stated that we should honor their

Construction Project Manager dated September 7, 2005, Re: Auto Zone, Ledgewood
Circle Shopping Center, 1113 Highway 46, Ledgewood, N.J. Councilman Rilee
stated that these fines that Auto Zone were issued are hefty and Mr. Bucco,
Township Attorney stated that a letter was sent to them from the Planning Board
Attorney, Tom Germinario and it stated if they do not get their Certificate of
Occupancy, the Township will apply to the Court to shut them down until final
site plan approval is obtained.
Councilman Rilee stated that four of our firemen will be
receiving plaques for putting their own lives at risk last Thursday evening
when a car crashed into a building and there was gas leaking everywhere and
they will be honored for their bravery. Mr. Raths will follow up with the
plaques to be given out to the firemen.
Mayor Zoschak also stated that these Firemen jumped off
their fire trucks when they heard people screaming in their car and got them
all out and that these Firemen went beyond the call of duty and they should be
commended.

Mr.
Church stated that the speed bumps like on Hercules Road do an effective job on
slowing traffic down and maybe these could be used on Dell Avenue. Mr. Raths
stated it couldn’t be done with large trucks traveling on the road. Mr. Bucco
stated that the compression brakes on these trucks would be triple the amount
of noise that they are currently making. Mayor Zoschak stated that speed bumps
work well at Shopping Centers.

Hall stated that Mt. Arlington Road was #1 on the list for the traffic
committee and that rumble strips slowed cars down before they approach the
speed humps and the combination of the two worked really well in this
particular area. Councilman Hall suggested we take Deputy Mayor Schmidt’s idea
and just park an empty Police Car in the area to slow down the traffic.

Raths stated the Township has put trees down to block the access of the
Kawasaki Dealership.

Alpaugh questioned Council if any of them planned on going to the seminar on
Eminent Domain and if they didn’t plan on it maybe they should.

DeFillippo stated that the Auto Zone Signs are all over town for their “grand
opening” and that they are located on Route 46 and Howard Blvd. Ms.
DeFillippo stated if they are doing business without a Certificate of Occupancy
they should not be allowed to have these signs around town. Ms. DeFillippo
also stated we need more Police Enforcement on Dell Avenue and Shippenport
Road.

Fred Hall stated he asked Mr. Raths about a month ago to hand out our sign
Ordinances. Mr. Hall stated we need to be more consistent in regards to our
sign ordinances.
Councilman
Schmidt stated that we need to do something so we can enforce the sign
ordinance. Mr. Raths suggested that the best thing to do would be is to drop
the “Notice of Violation”. Mr. Bucco stated that we have to amend the
Ordinance and that a warning does not have to be issued before a “Notice of
Violation” letter is sent, so therefore we can amend the Ordinance. Mayor
Zoschak stated he wants a study done before we go ahead and jump into
anything. Mr. Rilee stated this could open a can of worms. Mr. Raths stated
that we do pick up the signs as soon as we hear about them.

Schmidt stated that it seems that most of the signs are for out of town businesses
that he has received complaints about. Mayor Zoschak stated we have to have a
meeting with the local businesses in town before we do anything.
Mr. Church commented on the political signs that are put
up all over town. Mayor Zoschak stated that they are all legal and the town
cannot do anything about them.
