A Regular Meeting of the Township Council of the Township of Roxbury was held on July 8, 2008 at 1715 Route 46, Ledgewood, New Jersey at 7:30 PM.

 

OPEN PUBLIC MEETING STATEMENT

Adequate notice of this meeting of the Township Council of the Township of Roxbury was given as required by the Open Public Meetings act as follows:  Notice was faxed to the Daily Record, the Newark Star Ledger and the Roxbury Register on January 8, 2008; notice was posted on the bulletin board in the main hallway of the Municipal Building on January 8, 2008.

 

ROLL CALL (Present):  Deputy Mayor Kathy DeFillippo, Councilmen Gary Behrens, Jim Rilee, Martin Schmidt and Richard Zoschak

 

Also Present:  Christopher Raths, Township Manager; Anthony Bucco, Township Attorney and Janet Rieth, Deputy Township Clerk

 

Mayor Smith arrived at 7:35 PM.

 

Absent:  Councilman Fred Hall was on vacation.

Mr. Wine commented on the “affordable housing tax” being considered by Congress.

 

Mr. Gefert

Kings Highway, Landing

Mr. Gefert complained about the noise from the ATV’s on the McNear property.  He also complained about the dust and dirt from the McNear’s soil moving operation.  Mr. Raths will have Mr. Kobylarz check on this.  Mr. Raths will also speak with the Police Department regarding the noise from the ATV’s.

 

Edward Kirchgessner

Honeyman Drive, Succasunna

Mr. Kirchgessner read letters he received regarding dead trees and damaged plaques that are in need of replacement at Memory Lane.  He received these letters as far back as May of 2005 and the trees still have not been replaced.  He stated that he was a Councilman when he established Memory Lane and, at the time, the Council set up the Budget to allocate an annual sum of $1,000 to take care of these types of issues.  Mr. Kirchgessner asked why these situations have not been addressed. 

 

Mr. Schmidt stated that he has written a proposal that will be distributed to the Council within the next couple of weeks and will address most of Mr. Kirchgessner’s concerns. 

REPORTS OF COUNCIL LIAISON REPRESENTATIVES, COUNCIL COMMITTEES AND NEW BUSINESS/OLD BUSINESS

New Business

Morris County Railroad Matters:

Council discussed the lease agreement between Morris County and Morristown & Erie Railway, with Walter Krich, Jr., Director of Morris County Planning, Development & Technology; Jerry Rohsler, Morris County Transportation Director; and John Napolitano, Esq.  Mr. Krich stated that this agreement is limited to rail operations only.

 

Mr. Rilee asked if M&E could fall back on their federal exemptions. Mr. Bucco stated that since the County owns the rail line and the property he does not believe they can.  According to the terms of the new lease, the County must approve all operations, the operations must comply with all State, and local building and environmental requirements, and the railroad must obtain all applicable federal, State and local permits.

 

In furtherance of the discussion, as far as item #6 of lease agreement, the Council is vehemently opposed to the transfer of hazardous material at that location.  The County claims that, although the railroad is not currently transporting certain chemicals, they cannot prevent them from transporting those same chemicals in the future due to federal exemptions for “common carriers”.

 

Mr. Raths stated that he wrote a letter stating that Roxbury Township is firmly against loading of noxious chemicals along the rail line.   The Township will look into OSHA regulations regarding transfers of hazardous materials.  Mr. Raths will send a follow up letter regarding the points raised tonight

REPORTS OF COUNCIL LIAISON REPRESENTATIVES, COUNCIL COMMITTEES

Deputy Mayor DeFillippo presented a police report regarding accidents on the Route 206 corridor.  The report includes reports of accidents from Roxbury, Mt. Olive, Chester Township and Chester Borough, and was assembled by the Roxbury Police Department.  After reviewing the report, the Municipalities will schedule a meeting to discuss it further.

 

Deputy Mayor DeFillippo stated that there was an article in the Daily Record newspaper that rated Morris County as the 6th best County to live in.

 

Mr. Schmidt requested an update on the public’s ability to use credit cards for the court.  Mr. Raths stated that this is Ms. Spring’s #1 priority.  The hope is to have this capability by the end of this year.

 

Mr. Schmidt stated that all the hardware is in place for the security cameras at Horseshoe Lake, but they are still waiting for an antenna.  Mr. Schmidt stated that he expects a test to be performed later this week with the live feeds hooked up to the police cars.  Mr. Raths stated that this project is being done at no cost to the Township.  Mr. Rilee suggested that a sign should be placed at the entrance to Horseshoe Lake stating that the premises are under video camera surveillance.

 

Mayor Smith stated that the Summer Concert Series is scheduled to begin Friday night, July 11, 2008.

Mayor Smith asked about the “engine brake” that is referenced.  Mr. Blood explained that this is an internal engine brake, not an “exhaust brake” that makes excessive noise when operated.

Mr. Schmidt asked what the anticipated increase in cost for asphalt was expected to be this year.  Mr. Blood stated that the increase would be 10% based on the County co-op price that was established in December and was valid for the entire year. 

 

Mayor Smith commented on the need to continue to try and expend budgeted amounts of money from older Ordinances.  Mr. Raths stated that a summary of old Ordinances and balances would be presented to the Council along with the mid-year financial report.

#6  Correspondence from Lt. Kevin Fowler, NJ State Police, Office of Emergency Mgt., to All North Region OEM Coordinators, dated June 13, 2008, re:  FY 2009 EMA Applications

Mayor Smith asked if the Township would be applying for this grant.  Mr. Raths stated that we are in the process of applying.

 

#10 Correspondence from Senator Joe Pennacchio to Mayor, Roxbury Twp., dated June 19, 2008, re:  Resolution in Support of S-445, “Transparency in Government Act” which would provide for Establishment of State Public Finance Website

The Council agreed to prepare a resolution in support of S-445.

 

# 17 Notification to all Mayors, re:  request to oppose the elimination of State Contract for Park & Playground Equipment; “State of NJ is Considering Eliminating the State Contract for Park & Playground Equipment”

Deputy Mayor DeFillippo asked if the State has acted on the contract.  Mr. Raths said that he would look into this.

 

#19 Correspondence from Lake Hopatcong Commission to Commissioner Lisa P. Jackson, NJ DEP, dated June 24, 2008, re:  Update on plans in regard to the implementation of a user fee system

Mr. Rilee asked if the Lake Hopatcong Commission discussed the content of this letter, in regard to fees, prior to it being sent.  Mr. Zoschak stated that it was discussed.

 

 

 

 

#21 Correspondence from Chris Szentmiklosy, Legislative Aide, from Senator Bucco’s Office, dated June 26, 2008, re:  Township of Roxbury’s anticipated municipal aid

Mr. Rilee asked how these numbers compared to out budgeted amount.  Mr. Raths stated that we received $13,000 more.

 

July 3, 2008

#1-H  Shared Services

Deputy Mayor DeFillippo asked about the meeting date of July 17, 2008.  Mr. Raths stated that this meeting may be rescheduled to a different date.

 

#1-T  King’s Highway Drainage

Mr. Zoschak asked when the meeting was going to be held with the residents.  Mr. Raths stated that it would be within the next couple of weeks. 

 

#1-U  Hatch Mott MacDonald Services

The Council discussed the reassignment of Mr. Grau and possibly using a different company next year.  

 

#2  Draft of License Agreement between the Township of Roxbury and The Roxbury Art Alliance, Inc.

Mayor Smith recused himself from this discussion.  Mr. Schmidt stated that he did not think that liquor should not be served in a town building.  Mr. Schmidt would also like to have clarification on the use of the kitchen facilities. 

 

Deputy Mayor DeFillippo stated that the County allows liquor to be served at their parks as long as the correct permits are obtained.  She would like this to be explored further.

 

Mr. Bucco stated that this agreement was a draft and would like Council members to submit suggestions and/or comments.

 

The Council agreed to discuss the agreement further at the next workshop meeting.

 

Mayor Smith returned to the dais.

 

#7  Correspondence from Alex DeCroce, Republican Leader, General Assembly of NJ, to Mayor and Council, dated, June 26, 2008, re:  request to submit list of State Mandates that the Township would like to see reviewed to determine if they can be repealed or changed

Mr. Zoschak asked if we were going to put a list together in response to this correspondence.  Mr. Raths stated that he is going to ask the Departments Heads for their input.

 

#8  Correspondence from Dennis Wine, resident, to Governor Corzine, dated June 26, 2008, re:  A500/S1983 Affordable Housing Legislation

The Council complimented Mr. Wine on his letter.  Mr. Wine has not yet received a response from the Governor.

 

 

Mayor Smith amended to the agenda to the Public Portion.

 

PUBLIC PORTION

Maureen Castriotta

Ms. Castriotta requested that Council meeting dates be posted on the Township web site.  She also stated that there are no agendas listed after April 2008.

 

 

 

 

Robert Kluska

274 Emmans Rd., Flanders

Mr. Kluska stated that the agenda used to be available on the web site on Monday mornings before the meetings, but that they have not been there for the last couple of months.  Mr. Raths stated that he will look into this.

 

Mr. Kluska asked if the Township had accepted the Investors Bank donation for the Arts Alliance.  Mayor Smith described the Naming Rights policy.  Mayor Smith stated that the first step was to establish the policy.  The next step will be to approve the license agreement.  Upon completion of those two items, the Mayor believes that the money will be forthcoming.  Mayor Smith stated that the Council had previously approved the Naming Rights policy.

 

Mr. Kluska asked for an update on the installation of security cameras at Horseshoe Lake, as well as their location.  Council stated that they are located in various places.

08-276             RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF ROXBURY, IN THE COUNTY OF MORRIS, NEW JERSEY AUTHORIZING CONFERENCE OF THE TOWNSHIP COUNCIL WITH THE PUBLIC EXCLUDED

 

Mr. Rilee made a motion to adopt Resolution 08-276 for Executive Session.  Mr. Schmidt seconded the motion.
